By using EasyBoat, you agree to provide accurate information when creating an account and making bookings. You must be at least 18 years old to use our platform and must comply with all applicable local laws and regulations.

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

Bookings

Booking availability and confirmations are subject to owner approval. While we strive to ensure accuracy, availability may change, and owners reserve the right to decline bookings.

Cancellation policies vary by listing and are clearly displayed before booking. Both guests and owners are expected to honor confirmed bookings and cancellation policies.

Payment Terms

Payment is processed when a booking is confirmed by the owner. Refunds are handled according to the cancellation policy for each booking. All prices are displayed in EUR and include applicable taxes.

EasyBoat charges service fees to facilitate the platform, which are clearly displayed before booking confirmation.

User Responsibilities

Guests are responsible for following all safety instructions, treating boats with respect, and complying with all rules set by boat owners. Boat owners are responsible for maintaining safe, accurately described boats and honoring confirmed bookings.

Users may not use the platform for illegal activities, misrepresent themselves or their boats, or engage in fraudulent behavior.

Limitation of Liability

EasyBoat acts as a platform connecting guests and boat owners. We are not responsible for the condition of boats, the actions of boat owners or guests, or any incidents that occur during bookings. Users participate at their own risk.

Definitions

"Platform" means the EasyBoat website, apps, and related services. "User", "guest", and "owner" (or "host") have their ordinary meaning in the context of boat rental. "Booking" means a reservation confirmed through the platform. "Content" means any text, images, or other materials you submit.

Acceptance and Eligibility

By accessing or using EasyBoat, you agree to these Terms and our Privacy Policy. You must be at least 18 years old and have the legal capacity to enter into binding contracts. If you are using the platform on behalf of an organization, you represent that you have authority to bind that organization. We may refuse service or terminate accounts at our discretion for violation of these terms or for any other lawful reason.

Disclaimer and "As Is" Service

The platform and all listings, content, and services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. Listings are created by boat owners; we do not guarantee the accuracy, safety, or legality of any listing or the conduct of any user. You use the platform and participate in bookings at your own risk.

Indemnification

You agree to indemnify, defend, and hold harmless EasyBoat and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the platform, your content, your bookings, your violation of these Terms, or your violation of any law or third-party rights.

Governing Law

These Terms are governed by the laws of Spain, without regard to conflict-of-law principles. The courts of Spain shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or the platform, except where mandatory consumer law in your country requires otherwise.

Dispute Resolution

We encourage you to contact us first to resolve any dispute. For users in the EU, you may use the European Commission's online dispute resolution platform. Nothing in these Terms limits your right to bring a claim before the courts of your place of residence where applicable law so permits.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy (if any), and any additional terms presented when you use specific features, constitute the entire agreement between you and EasyBoat regarding the platform and supersede any prior agreements or understandings.

Modifications

We may modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be communicated by email or notice on the platform. Your continued use of the platform after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the platform.
